Welcome to PLab Software ("Company," "we," "our," "us")!
These Terms of Service ("Terms," "Terms of Service") govern your use of our web pages, mobile application and driving school management services ("Services"), located at https://plabsoftware.nl and operated by the Company.
Our privacy policy also governs your use of our Services and explains how we collect, safeguard and disclose information that results from your use of our platform ("Privacy Policy"). Please read it here: https://plabsoftware.nl/privacy.
Your agreement with us includes these Terms and our Privacy Policy ("Agreements"). You acknowledge that you have read and understood the Agreements, and agree to be bound by them.
If you do not agree with (or cannot comply with) the Agreements, then you may not use the Services, but please let us know by emailing us at support@plabsoftware.nl so we can try to find a solution. These Agreements apply to all website visitors, users and others who wish to access or use our Services.
You may access our Services by creating an account ("Account") through Google Sign-In authentication. We may also provide you with access to use our free trial services at any time. We will provide you with access to use the Services as described in these Terms and the applicable subscription plan.
You must be 18 years of age or older to use the Services as a driving school owner or operator.
By creating an Account on our Services, you may subscribe to newsletters, updates or other information we may send. You may opt out of receiving any, or all, of these communications from us by following the unsubscribe link provided in the communications or by emailing at support@plabsoftware.nl.
If you wish to purchase any subscription plan or service made available through our Services ("Purchase"), you may be asked to supply certain information relevant to your Purchase. If you are paying by credit card or other payment method, you authorize us to use a third-party payment processor to charge your Purchase payment and you consent to the disclosure of your payment information to such third-party.
You represent and warrant that: (i) you have the legal right to use any payment method(s) in connection with any Purchase; and that (ii) the information you supply to our authorized third-party is true, correct and complete.
We reserve the right to refuse or cancel your order at any time for reasons including but not limited to: service availability, errors in the description or price of the service, error in your order or other reasons.
We reserve the right to refuse or cancel your order if fraud or an unauthorized or illegal transaction is suspected. All payment obligations are non-cancelable and all amounts paid are non-refundable, except as specifically provided in these Terms.
All fees are exclusive of taxes. You agree to pay any taxes applicable to your use of the Services, including VAT where applicable in the Netherlands and EU.
Some of our Services are billed on a subscription basis ("Subscription(s)"). You will be billed in advance on a recurring basis ("Billing Cycle"). Billing Cycles are typically set on a monthly or annual basis, depending on the type of subscription plan you select when purchasing a Subscription.
At the end of each Billing Cycle, your Subscription will automatically renew under the exact same conditions unless you cancel it or the Company cancels it. If you do not wish to renew your Subscription, you must cancel at least 24 hours prior to the end of the current term through your account settings.
You may choose to cancel your Subscription early at your convenience, however, we will not provide any refunds of prepaid or unused portion of the Services, and you will continue to have access through the end of your current billing period.
A valid payment method is required to process the payment for your Subscription. You shall provide the Company with accurate and complete billing information. By submitting such payment information, you automatically authorize the Company to charge all Subscription fees incurred through your Account.
Should automatic billing fail to occur for any reason, the Company will issue an electronic invoice indicating that you must proceed manually with the full payment within a specified deadline.
The Company, in its sole discretion and at any time, may modify Subscription fees for the Subscriptions. Any Subscription fee change will become effective at the end of the then-current Billing Cycle.
The Company will provide you with reasonable prior notice of any change in Subscription fees to give you an opportunity to terminate your Subscription before such change becomes effective.
Your continued use of our Services after a Subscription fee change comes into effect constitutes your agreement to pay the modified Subscription fee amount.
You own and retain all rights to your driving school data, student information, and business data. You grant permission to us to use your data only as necessary to provide the Services to you and as otherwise permitted by these Terms.
We may collect information and data when you interact with our Services as permitted by these Terms and our Privacy Policy. We may use aggregated, anonymized data for improving our Services and developing new features.
By using our Services, you agree that your data may be processed in accordance with applicable data protection laws, including GDPR, and our Data Processing Agreement where applicable.
Our Services allow you to post, store, share and manage information related to your driving school operations, including student data, lesson schedules, instructor information, and vehicle details ("Content"). You are responsible for Content that you input into our Services, including its legality, accuracy, and appropriateness.
By using our Services, you represent and warrant that: (i) you have the right to use and input the Content, (ii) the Content is accurate and lawful, (iii) your use of our Services complies with all applicable laws and regulations related to driving instruction and student data protection.
License Grant: You retain ownership of your Content. You grant us a limited license to use your Content solely to provide the Services to you, including storing, processing, and displaying the Content within your account.
Company Content, including our software, features, and documentation, remains the exclusive property of PLab Software. You may not distribute, modify, or reuse Company Content without express written permission.
You agree to use our Services only for lawful purposes related to driving school management. When using our Services, you agree not to:
Our Services use Google Sign-In for authentication. By using Google Sign-In, you agree to Google's Terms of Service and Privacy Policy. We receive only basic profile information necessary for account creation and authentication.
Our use of information received from Google APIs adheres to the Google API Services User Data Policy, including the Limited Use requirements.
You may revoke our access to your Google account at any time through your Google account settings.
Our Service is intended for driving school owners and operators who are at least eighteen (18) years old. By accessing or using our Services, you warrant that you are at least eighteen (18) years of age.
While driving students may be minors, any data about minors must be input by authorized driving school personnel with appropriate consent and in compliance with applicable privacy laws.
When you create an Account, you guarantee that the information you provide is accurate, complete, and current. You are responsible for maintaining the security of your Account and all activities that occur under your Account.
You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your Account by emailing support@plabsoftware.nl.
We reserve the right to refuse service, terminate Accounts, or restrict access to our Services in our sole discretion, particularly for violations of these Terms.
Our Service, including all features, functionality, software, trademarks, and trade dress, remains the exclusive property of PLab Software and its licensors. Our Services are protected by copyright, trademark, and other intellectual property laws.
Except as expressly granted in these Terms, all rights, title and interest in and to the Services remain with PLab Software.
EXCEPT AS PROHIBITED BY LAW, IN NO EVENT WILL PLAB SOFTWARE BE LIABLE FOR ANY INDIRECT, PUNITIVE, SPECIAL, EXEMPLARY, INCIDENTAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.
OUR MAXIMUM AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR €500, WHICHEVER IS GREATER.
This limitation applies to all claims, whether based on warranty, contract, tort, or any other legal theory.
You agree to defend, indemnify and hold harmless PLab Software from any claims, damages, or expenses arising from: (a) your use of the Services, (b) your violation of these Terms, (c) your violation of any rights of a third-party, including student privacy rights, (d) any Content you input into our Services.
We may terminate or suspend your Account immediately, without prior notice, for any breach of these Terms or if we suspect fraudulent or illegal activity.
You may terminate your Account at any time by contacting us at support@plabsoftware.nl. Upon termination, we will provide you with an opportunity to export your data for a limited period.
All provisions that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
These Terms shall be governed by and construed in accordance with the laws of the Netherlands. Any disputes shall be resolved in the competent courts of the Netherlands.
We may update these Terms from time to time. We will notify you of any material changes by posting the new Terms on our platform and updating the "Last updated" date. Your continued use of the Services after changes become effective constitutes acceptance of the updated Terms.
